Confiscation of Property: Aims of Regulation and Legal Preconditions for Extended Powers of Confiscatin in Lithuania

Summary/Abstract: The article deals with confiscation as one of the legal measures intended, on the one hand, for the punishment of the person who has committed a crime, and, on the other hand, for the prevention of economic crimes or other offences. According to what is the aim of the state – to punish a person or to prevent him from doing a crime, the state construes legal provisions relating confiscation of crime. International documents and as well framework decision of the European Union prompts member states to establish a regulation of confiscation which would enable to confiscate all the economic value of the crime committed. On of such measures, provided for in Council Framework Decision of 25 February 2005 is extended powers of confiscation. Extended confiscation may be imposed for organized criminal acts listed within the Framework Decision. The article analyses peculiarities relating regulation of confiscation taking into account the targets of the state subject to regulation of confiscation and the possibilities and needs to provide extended confiscation within the Criminal Code of the Republic of Lithuania.
