Analysis of the Legislation on Children's Nutrition

Summary/Abstract: The present study analyzes the legal framework on children’s nutrition as an element of the legal protection of children’s health. The rules for children’s nutrition up to 3 years, for children between 3 and 7 years and for children over 7 years of age are separately analyzed, as well as common nutrition rules for all age groups, such as the EU school fruit, vegetables and milk scheme, which is co-funded by the European Union. Restrictions and prohibitions on the children’s nutrition with certain foods and substances are also considered. The present study analyzes not only the ban on smoking, alcohol use and consumption of genetically modified food by children, but also legislative measures to prevent them, including international ones – i.e. the World Health Organization (WHO) Framework Convention on Tobacco Control. A rich regulatory framework, including the EU legislation applicable to the topic, is cited. Attention is also paid to the rules for the production of baby foods and infant formulas. The present study pays particular attention to breastfeeding promotion measures, in line with WHO recommendations. The rules of the WHO International Code of Marketing of Breast-milk Substitutes are reviewed and an answer is given to whether and to what extent the Bulgarian legislation has implemented the rules of the Code. The work ends with a conclusion that attempts to summarize the results of the existing of a rich legal basis for healthy nutrition of children.
