Direct Effect of EU Mixed Agreements

Summary/Abstract: The article discusses an element of the current status of mixed agreements in the EU. It focuses on the lack of direct effect. In juxtaposing the legal framework in the EU and some of its more important trading partners, primarily the U. S., the article strives to recognize certain idiosyncrasies in the legal systems that make the reception of the foreign approach to the matter politically acceptable, yet legally challenging. Further, it analyses the judicial practice of the CJEU, identifying elements that bear streamlining.
