Summary/Abstract: The present article aims to analyse the legal effects of the entry of applicable marital property regime into the Central Electronic Register of Property Relations of Spouses under Art. 19, para 1 of the Family Code (2009). The Register is hosted by the Registry Agency. It has been introduced into the Bulgarian legal system for the first time in 2009. Subject to entry in the Register are the spouses’ declarations by which they choose the applicable marital property regime as well as their marriage contracts. The registration procedure takes place ex officio. Every person has a right to access the Register of Property Relations of Spouses and to request extracts from it. The main function of this system of registration is to protect the legal interests of third parties. Should the chosen matrimonial regime, as well as the matrimonial contract, have not been entered into the Register, they cannot be invoked against any third parties (Family Code 2009, Art. 20). If there is no matrimonial regime registered, the matrimonial property regime of the spouses shall automatically be the statutory regime provided by law – marital community property under Art. 21–32 of the Family Code.
