Summary/Abstract: Fundamental rights and freedoms of the individuals can be restricted for the sake of protection of certain values which are normative categories. The common interest is sometimes seen as one of the values justifying and legitimizing the restrictions imposed on the sphere of the individual’s freedom. This text attempts to highlight the risk which is generated by application of the normative category of common interest. It can be easily abused due to its definitional incoherence and vagueness.
