Summary/Abstract: The institute of pardon's age and its continuous presence in Serbian Law, which can be tracked down from the medieval period and followed through the positive legislation, should not be obstacles to critical analysis of this institute, since they don't necessarily bring about the perfection in normative regulation. Hence, in author's opinion, both in substantive and procedural sphere of pardon certain flaws and illogicalities may be found, starting from uncommonly broad contents, where particularly controversial element is abolition, to ambivalent position of the first instance court and lack of control mechanisms.
