Summary/Abstract: The roman law has evolved by theme ans of procedure, as the formalism and the strict interpretation of the roman laws transformed, under the creative influence of the praetor, into procedural instruments intended to help the valuation of the citizens’rights, in full agrement with the evolution of the social relations of the roman society. From this perspective, the roman lawseems to have folowed a trueinitiaticpath, a socalled via crucis, in its evolution, frmthelegisactiones to the formula procedure, from the strictumius to the fide bona.
