Illegal Disposal of Prohibited Substances and Methods in Sport: Issues of Criminalization

Summary/Abstract: The increasing focus on clean sport, perceptions of fair play and general concern of public health also reflect in the legal and criminological research areas. The article deals with the concept of legal regulation of illegal disposal of prohibited substances and methods in sport in the context of Lithuanian and other European Union countries law. In view of the biomedical and criminological research as well as case analysis of the prevalence and dangerousness of said actions, the article provides the guidelines for the criminalization and proposes specific additions to the Criminal Code of the Republic of Lithuania. The most rational way is to set criminal responsibility for illegal disposal of doping considering already existing laws related with illegal disposal of drugs. Such a way does not contradict with entire legal system of Lithuanian criminal law herewith international standards are implemented.
