Summary/Abstract: Seimas of the Republic of Lithuania enacted a new wording of Law on the Rights of Patients and Compensation of the Damage to their Health. The law will be become effective since 1 March 2010. In this article an author analyses and educes the methods of solving health care disputes, indicates compulsory extrajudicial dispute procedures, notes the theoretical and practical problems of implementation and provides issues of it. The analysis performed enables the author to draw conclusions that Law on the Rights of Patients and Compensation of the Damage to their Health indicates two different types of compulsory extrajudicial dispute procedures: right to complaint and right to compensation. Health care provider is the one institution for compulsory extrajudicial health care dispute procedure of patient’s right to complaint and Commission on evaluation of damage inflicted upon the health of patients is the one institution for compulsory extrajudicial health care dispute procedure of patient’s right to compensation. The laws of the Republic of Lithuania abridge the implementation of patient‘ s right to defense his breached rights at some points.
