Summary/Abstract: he article discusses principles of physician’s conduct and his rights towards aggressive patient. Among the rights, the right of withdrawal from treatment dominates therein. The authors analyze article 38 of the Law on profession of a doctor and a dentist and 7 Code of Medical Ethics in context of possibility of using competences therein expressed to aggressive patient, excluding the issue of mental disorder. The aggression in healthcare is indisputably a global issue, what is proved by the WMA’s concern on this subject and implementation of the MAWOZ system in Poland. Indubitably, all physicians have the right to work in a safe environment without the threat of violence. Violence against health workers, including physicians, not only affects the individuals directly involved, but also impacts on the entire healthcare system and its delivery. Thereon, the great issue is to maintain a balance between patients’ and physicians’ rights.
