Criminal responsibility of the head of the operating team in case of leaving a foreign body in the treatment area

Summary/Abstract: The article presents the issues of criminal liability of the chief operating surgeon in the case of a procedure that results in leaving a foreign body in the site of surgery. The position that the physician managing the surgical team will always be responsible for leaving the foreign body in the operating field can and should be approached with just criticism. The authors point to the issue of the limits of the responsibility of the physician in charge of the surgery in relation to the mistakes made by other team members.
