Summary/Abstract: The legal basis for the decision of the insulating safety measure are articles 93a–d and 93g of the Criminal Code. The content of the prerequisites laid down therein is based, inter alia, on the standards developed in ECHR case law. Therefore, it is important to approximate in the light of the Strasbourg case law these prerequisites, as well as the rules for this insulating security measure, including: the principle of legal certainty, no arbitrariness, court order, principle of necessity (ultima ratio), principle of proportionality, mandatory nature of objective expert opinion.
