SELECTED ISSUES OF FAMILY LAW DURING THE MORTGAGE AND LAND REGISTER PROCEEDING

Summary/Abstract: The subject of this study are selected specific issues regarding the impact of substantive familylaw on the Mortgage and Land Register proceeding. The analysis of selected practical problems ofthe Mortgage and Land Register proceeding related to real estate trading will enable an attempt topresent proposals for their resolution. Initially, the issue of the statutory property regime of spouseswill be presented in the context of the Division II of the Mortgage and Land Register. Subsequently,the issue of the circle of participants in the Mortgage and Land Register proceeding covering thejoint property of the spouses will be subject to assessment. Finally, the nature of the permission of theguardianship court granted to parents to carry out activities beyond the scope of ordinary managementin the Mortgage and Land Register practice will be discussed.
