Summary/Abstract: The article presents the issue of the conscience clause in the context of the exercise of the right to freedom of conscience. Human rights express normatively innate human dignity which is the source of individual rights. The essence of the so-called conscience clause is responding to a situation where a legal norm requires the addressee to behave in a way that is contrary to his/ her conscience, thus interfering with the essence of the right and freedom of man to conscience. Therefore, without the protection of the right to freedom of conscience, the protection of human right to such freedom is mock imitation or façade. The clause of conscience, which should be an exception, not a rule, is the realisation of this right in the event of its statutory restrictions.
