Summary/Abstract: The court of first instance sentenced the defendant to 3 months imprisonment for committing the bribery offense, pointing out that his tacit acceptance of the promise made by the witness to obtain material benefits in connection with the discharge of his duties of the defendant, is unequivocally apparent from the content of the environmental record made at the meeting between the two on March 28, 2013. However, the court of appeal acquitted the defendant, stating that although the above-mentioned registration contains elements that would lead to the existence of an activity of criminal nature, it is not corroborated by other evidence to support the accusation. The discussion with illegal connotation, not being concretized by the administration of other evidence to confirm it, is not sufficient to establish the existence of the culprit and the guilt of the defendant.
