Summary/Abstract: In the new civil code the legislator does not show the reasonable grounds for reinstatement the prescription period. Findings by courts or tribunals of the circumstances that could be retained as a basis for extending the prescription term implies a deepened analysis and a careful weighing of the facts, without which the border between duly justified cases and those that do not enjoy such justification could be easily overcome and lead to solutions and different resolutions in similar cases.
