Summary/Abstract: The regulation of compensation in the civil code is found in title VII entitled "Termination of duty" in Chapter II art. 1616 to art. 1623. This regulation proposes a better regulating legal regime of the legal institution, regulating expressly a number of issues that have been raised by the doctrine and jurisprudence. Here are expressly specified the conditions and effects of issues such as: waiving compensation in Romanian law, the benefit of compensation, the granted period, effects against third parties and the transfer or mortgage of a claim.
