Summary/Abstract: One of the aims of the paper is to shed some light on the controversy caused by the interpretation of the legal provisions in Criminal Law and the Law no. 188/1999 regarding the public servants status, seeking clarification on the teaching staff status in relation to the public servant quality, regarding certain actions undertaken by these. The article examines the legal implications posed by the exams fraud and what are the penalties provided for all involved, thus illustrating the importance of a genuine and fair assessment of the intellectual skills the student possesses, while helping to maintain an adequate educational system.
