CERTAIN CONSIDERATIONS ON FORCE MAJEURE AND FORTUITOUS EVENTS IN THE REGULATION OF THE NEW CIVIL CODE

Summary/Abstract: The causes exempting liability were regulated in the new Civil Code, art. 1351 - 1356. The legislature was concerned regarding the causes that exclude the very existence of a causal relationship, as a necessary objective tort liability. Their regulation gives rise to issues on which we want to make certain clarifications.
