Summary/Abstract: Since ancient Greek philosophy and Roman law, the ideas for the common good (the public interest) and its correlation with the private interest, have been constant issue in the Western political philosophy. Considering the multiple manifestations of “Publicum bonum privato est praeferendum“ in the modern state government, sometimes the keeping of guarantees for its observance turn out to be both a challenge and а goal hard to achieve. “Publicum bonum privato est praeferendum“ is one of the possible approaches in the activity of the administrative authorities and has exceptional (binding) force, only when the public interest prevails in favour of protection of particularly important state and public interests, but not for protection of all state and public interests.
