Summary/Abstract: This paper analyses surrogacy form a human rights perspective, making a comparative description of the foetus’ rights and the rights of his/her biological/legal/surrogate parents, presenting the main advantages and drawbacks of surrogacy, the way it is regulated in international agreements, as well as certain representative cases from the legal judicial practice recorded in the United States of America.
