Summary/Abstract: The approach of the civil partnership question, de lege ferenda, shall trigger any susceptibility in Romania. The persons opting for tradition reject any establishment of a legal framework for this purpose, by promoting the solution of the constitutional block of the definition of family. The other direction opposes the latest legislative evolutions in the European West and in the North-American space for supporting a transposition of the Romanian law to the modernity of a certain freedom of the family formation. The study is aimed at checking, through an analysis such as the law history and the legal sociology, the adequacy of the debate about the civil partnership in Romania: terminology, legal, historical and sociological arguments in relation to the possible regulation of the institution, the correlation between the concrete sociological position of family and its legal pose in the Romanian laws, first in the fundamental codes.
