Summary/Abstract: W artykule została omówiona instytucja jednoczesnego orzekania kary pozbawienia wolności i kary ograniczenia wolności określana jako sekwencja kar, wprowadzona do art. 37b Kodeksu karnego ustawą z dn. 20 lutego 2015 r. (Dz.U. poz. 396), w kontekście nowelizacji prawa karnego ustawą z dn. 11 marca 2016 r. o zmianie ustawy – Kodeks postępowania karnego oraz niektórych innych ustaw (Dz.U. poz. 437), w wyniku której do treści art. 37b k.k. zostało dodane nowe zdanie głoszące: „Przepisów art. 69–75 nie stosuje się”. Przeprowadzone analizy zostały oparte na metodzie analizy dogmatycznej w prawie karnym, a także metodzie analizy krytycznej w zakresie spotykanych w nauce prawa karnego poglądów na temat art. 37b k.k., uwzględniając ustalenia z zakresu teorii prawa, w szczególności koncepcję normatywności znaczenia i języka dyskutowaną przez filozofów języka oraz zjawiska redundancji semantycznej i superfluum na gruncie Kodeksu karnego. Pomocniczo została wykorzystana metoda uwzględniająca rolę dewiacji semantycznych w analizach lingwistycznych. W rezultacie przeprowadzonych rozważań zarysowano, iż sekwencyjna kara pozbawienia wolności orzekana na podstawie art. 37b k.k. w żadnym przypadku nie mogła być warunkowo zawieszana na okres próby przed wejściem w życie ustawy nowelizującej z 11 marca 2016 r., tj. przed dniem 15 kwietnia 2016 r. Począwszy od 15 kwietnia 2016 r. sekwencyjna kara pozbawienia wolności wymierzana na podstawie art. 37b k.k. może zostać warunkowo zawieszona na okres próby na podstawie art. 60 § 5 k.k., którego to przepisu nie zawiera klauzula: „Przepisów art. 69–75 nie stosuje się”. The article discusses the institution of simultaneous adjudication of deprivation of liberty and a restriction of liberty called sequence of the penalties which was introduced by the Act of 20th February 2015 (Dz.U. 396) into Art. 37b of Polish Criminal Code (k.k.), in the context of amendment of the criminal law introduced by the Act of 11th March 2016 amending the Act – Code of Criminal Procedure and some other acts (Dz.U. 437), as a result of which it has been added to Art. 37b k.k. a new sentence proclaiming: „The provisions of Art. 69–75 k.k. do not apply”. The analysis is based on the dogmatic method of analysis of the criminal law and method of critical analysis of the presented views on the art. 37b k.k. in jurisprudence, including the findings of the theory of law, especially the concept of normativity of meaning and language discussed by philosophers of language, as well as the phenomena of semantic redundancy and superfluum appearing in the text of the Criminal Code. Incidentally, the method taking into account the role of semantic deviations in the linguistic analysis has been applied. As a result, it has been proposed that the sequential deprivation of liberty imposed on the basis of Art. 37b k.k. could not be conditionally suspended for a trial period before the entry into force of the Act of 11th March 2016, that means before the 15th April 2016. Starting from 15th April 2016 sequential deprivation of liberty imposed on the basis of Art. 37b k.k. may be conditionally suspended for a trial period pursuant to Art. 60 § 5 k.k., because the clause „The provisions of Art. 69–75 k.k. do not apply” does not contain the provision of Art. 60 § 5 k.k.
