Summary/Abstract: Sąd Najwyższy przyjął, że osoba, która uruchomiła przebieg przyczynowy i swoim zachowaniem znacząco zagroziła dobru prawnemu, nie jest zwolniona z odpowiedzialności karnej za nastąpienie skutku, mimo że gwarant nienastąpienia skutku nie wykonał później ciążącego na nim obowiązku uratowania tego samego dobra prawnego. Autorka wskazuje, że komentowane postanowienie jest zgodne z dotychczasowym orzecznictwem Sądu Najwyższego i przeprowadza analizę kilku wariantów zachowań osób trzecich, w szczególności lekarza włączającego się swoim działaniem albo zaniechaniem w przebieg przyczynowy. The Supreme Court accepted that the person who initiated the causal connection and with her/his behavior significantly endangered the legal interest is not absolved from criminal liability for the occurrence of the consequence described in criminal provision, although third parties who were supposed to break the undertaken casual process and to prevent the threat to the legal interest, did not fulfilled their obligations. The author indicates that the discussed decision is coherent with previous rulings of the Supreme Court and conducts analysis of few variants of behaviors of third parties, especially medics, who by theirs actions are involved in the causal connection.
