Summary/Abstract: A thorough amendment of the Code of Criminal Procedure introduced by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396) included also the provision of art. 167 § 1 of Code of Criminal Procedure. The article is aimed at discussing problems with interpretation and practical issues concerning the evidentiary proceedings in the context of entering into force of the amended art. 167 § 1 of Code of Criminal Procedure.
