Summary/Abstract: The objectives are set out: protection, to preserve and improve the quality of the environment, protecting human health; the prudent and rational utilisation of natural resources; integrating environmental requirements into other Community policies; promoting international measures for regional issues or planetary environment. To achieve them are provided for a number of principles: preventive action, correcting pollution with priority at source (principle proximity), precautionary principle and polluter pays principle. The requirement of a high level of environmental protection falls within the same fundamental goal of "internal market", allowing, at least theoretically, to avoid the obstacle lowest common denominator of Member States. Despite such political and legal development, there is currently no text of European Community law expressly and positively to devote fully deserve a "healthy and ecologically balanced." This is explained by the peculiarities of such a right and imperfections of the current stage of European construction. However, a number of developments in this regard are becoming more obvious.
