Summary/Abstract: Directiva 2003/88/EC cuprinde anumite cerinţe privind organizarea timpului de lucru iar CJUE a dezvoltat aceste cerinţe până la punctul în care includerea unei perioade în timpul de lucru nu mai este condiţionată de intensitatea muncii dar nici măcar de prestarea efectivă a muncii. Includerea în timpul de lucru a perioadelor inactive în care angajatul se află la locul de muncă a determinat anumite probleme economice vizând costurile forţei de muncă. Ca răspuns la aceste probleme s-a manifestat de către angajatori fie tendinţa de flexibilizare a programului de lucru fie tendinţa de a găsi soluţii pentru creşterea intensităţii muncii şi reducerea perioadelor inactive la locul de muncă. Una dintre posibilităţi este sistemul de employee sharing care în esenţă presupune folosirea forţei de muncă a unui angajat de mai mulţi angajatori în funcţie de nevoile lor la un anumit moment. Articolul prezintă acest mod de organizare a muncii şi maniera de aplicare a acestuia în unele state membre UE şi posibilităţile oferite de legislaţia din România în lipsa unei reglementări exprese. Directive 2003/88/EC contains some requirements on the organization of working time and the CJEU has developed these requirements to the point where the inclusion of a period during working time is no longer conditioned by the intensity of work but not even by the actual performance of work. Inclusion during working hours of inactive periods in which the employee is at work has led to certain economic problems affecting labor costs. In response to these problems, employers either showed a tendency to flexible work schedules or to find solutions to increase work intensity and reduce inactive periods at work. One of the possibilities is the employee sharing system, which essentially involves using the work force of a employee by more employers according to their needs at a certain point in time. The article presents this way of organizing work and the way it is applied in some EU member states and the possibilities provided to this end by the Romanian legislation in the absence of express regulation.
