APPLICATION OF EU LAW IN NATIONAL CASE LAW

Summary/Abstract: Abstract:The paper summarizes judgments delivered recently by the Italian Supreme Court of Cassation in relation to the definition of working time and its delimitation from rest time, accompanied by the author's comments. In the analysis of these court decisions it is noted the inclusion in the working time of the periods affected to: the dressing and undressing of the work clothes and those necessary for the delivery / receipt of the service at the entrance and exit of the shift; movement between the place of access to the enterprise at the workplace before and after the start of the activity and the periods in which the employee remains on the premises.Rezumat: Lucrarea prezintă în sinteză hotărâri pronunţate în perioada recentă de Curtea Supremă de Casaţie Italiană în legătură cu definirea timpului de lucru şi delimitarea acestuia de timpul de odihnă, însoţite de comentariile autorului. În analiza acestor hotărâri judecătoreşti se remarcă includerea în timpul de lucru a perioadelor afectate: îmbrăcării şi dezbrăcării uniformei şi a celor necesare predării/primirii serviciului la intrarea şi ieşirea din tură; deplasării între la locul de acces în incinta întreprinderii la locul de muncă înainte şi după începerea activităţii şi perioadele în care rămân în incintă.
