Summary/Abstract: The text of the Convention is the first of this kind establishing a control mechanism how states to discharge obligations under the signature of maximum interest in the procedures provided for this purpose, to the extent that inspired other regional systems. Being adopted by the Council of Europe, were called and the two branches of his - Parliamentary Assembly and the Committee of Ministers and the specialized institutions were created Commission and European Court of Human Rights. Trends law of the Court are: prudence and stability in European practice, subsidiary of European control mechanism, not a replacement law, which remains the main instrument of protection. The Court recognizes states a certain "margin of appreciation", stating a noticeable moderation in controlling how the national courts interpret and apply their national law.
