Summary/Abstract: Although the political rights of military personnel exist in all the analyzed legal systems, regarding the ways permitted by law to exercise them, some quite significant differences may appear. In Spain, Italy, Portugal and Germany the military are allowed to run for elective political positions if they are passed in a special statutory position at the time of their candidacy. The Netherlands appears to have the most permissive legal framework, given that, from the interpretation of the relevant legal texts, it appears that the Dutch State considers as normal and desirable the participation of its citizens, including the military, in politics, providing the elected militaries the benefit of the rights of seniority in the service and advancement in rank during the exercise of an elective office
