Summary/Abstract: Non-consensual sexual intercourse is a new criminal offence in Croatian criminal law, introduced by new Criminal Code, which was adopted in 2011 and started to aplly at the beggining of 2013. This criminal offence combines different offences from the old Criminal Code, but also moves one step further by introducing new and controversial concepts such as sexual intercourse by deception and negligent sexual intercourse. These concept are new to the Croatian criminal law. In this paper the author will analyse legislative structure of this new criminal offence and he will also give his critical overwiev. He will take into consideration relevant cases from Croatian case-law.
