Summary/Abstract: The present study analyzes the double circumstance that the legislator has set up on the active subject of the criminal offense of embezzlement, which must be, on the one hand, a civil servant or a person referred to in art. 308 of Criminal Code and, on the other hand, the manager or administrator of money, values or goods.
