About the action (un)usefulness in tabular performance

Summary/Abstract: The present paper seeks to identify how the legal enforcement of sales contracts interfere with the mechanism of the transfer of the property right into the legal-constitutive system of the enlisting in the land registry. The action of real estate registration has been amended several times in the regulation of the current Civil Code and allows the recipient of the transmission to require the transmitter to perform all the obligations necessary for the registration of the right. We have followed a short history of the action of real estate registration (1), the way in which the meaning of legal enforcement of sales contracts has evolved (2), the justification of the action under an apparent overlap with an action in the performance of a contractual “to do” obligation (3) and brief assessments on the prescriptive nature of such action (4).
