Annulment of the cadastral number in the case of the land book actions. Short considerations

Summary/Abstract: The cancellation of cadaster numbers, although stipulated under the Regulation adopted by Order of National Agency for Real Estate Publicity and Cadastre Director no. 700/2014, seems to establish, in the light of recent case law, a new meaning for the land register correction. The procedure has been accepted by the courts of law that consider it to be a distinct plea or claim that could lead to the correction of the real estate register. However, the cancellation of cadaster numbers must be brought down from the artificial pedestal and put to its right place, among the technical and legal operations necessary for the rectification of the land register. This article is a brief overview of the relevant legislation and the technical terminology employed by the cadastre and real estate register offices. The cancellation of cadaster numbers is also addressed from the perspective of strict operations for the modification of cadaster entries and also for its application in specific cases of land book register corrections.
