On the Procedure for Election of Judges in the European Court of Human Rights

Summary/Abstract: The article makes a critical analysis of the draft regulation (Order of the Minister of Justice) issued on 27 August 2014 on the internet site of the Ministry of Justice launching a public debate with regard to the criteria and the procedure for the nomination of list of national candidates for judges in the European Court of Human Rights (ECtHR). The provisions of the said legal regulation are compared with the requirements and the criteria concerning the election of judges in the ECtHR under the European Convention on Human Rights (ECHR) and the relevant other Recommendations and Resolutions of the Parliamentary Assembly of the Council of Europe. Under consideration are the relevant aspects of the procedures carried out recently in other state parties to the ECHR which may serve as model to be followed in the forthcoming national nomination procedure, which is to nominate a new judge to replace the current Bulgarian judge Ms Zdravka Kalaydijieva who announced recently her resignation from the post held at the ECtHR as of 1 March 2015.
