Summary/Abstract: This article analyses mandatory mediation in the context of everyone’s right to a fair trial as it is guaranteed by the Constitution and international as well as the European Union law. The author’s starting point is the example of the Italian jurisdiction. Then, two verdicts of the Tribunal of Justice of the UE referring to the issue are presented, namely the verdicts in the case of Rosalba Allasini and in the case of Livio Menini. They provide a framework for analysing mandatory mediation under Polish law. An attempt to answer a question whether mandatory mediation might be an effective instrument to counteract one of the greatest dysfunctions of contemporary justice system which is lengthiness of court proceedings.
