Summary/Abstract: Breach of trust by public officer is set out in art. 297 of the new Penal Code and the content of the offence is much more synthesized, concise and with lesser chances to be subject to controversy. The author emphasizes that the above-mentioned offence actually comprises the breach of trust against individuals, the breach of trust by limi-tation of certain rights and the breach of trust against the public interest (as provided by art. 246, art. 247 and art. 248 in the Penal Code of 1968).
