Summary/Abstract: This paper analyzes the way in which the criminal law doctrine of Romanian authors proposes to understand the criminal offense. Typicality, guiltiness, imputability,unlawfulness are, in fact, specific notes of criminal offenses, as they are analyzed and developed by the criminal doctrine, and not the elements or the sides of the offense.Legal considerations relating to the presumption of innocence depend on this understanding.
