Summary/Abstract: The doctrine emphasizes doubts whether defamation may concern a deceased person. That seems to result from the construction of personal goods. However, negative statements about the dead that violate the personal rights of relatives can constitute a crime of defamation. Defamation may result in loss of trust or humiliation in the public opinion. The journalists, however, are protected by both countertypes from article 213 of the Penal Code, as well as by – less stressed in practice – countertypes of article 41 of the Act on press law.
