Summary/Abstract: For decades now there seems to be a kind of proceduralism dominating the debates onthe philosophical theories of justice, according to which from a normative perspectiveonly those procedures can be counted as democratic or equitable, with the help of whichcitizens can decide on their own about the creation of a just society. However, this liberalconsensus has its own limits, since the adequacy of procedures can only be evaluated afterthose conditions are set, which make possible for the participants to deliberate freely andin an equal way. The philosophical theories of justice cannot be narrowed down to a corecontaining only a modest idea of a justifying procedure, rather, it should go beyond theparticipants in order to include suggestions about the ways in which freedom and equalitycan be comprehended in a proper way. However, this article is not only about these methodologicalproblems, it works out the basis of an alternative concept of justice as well.
