Summary/Abstract: The author analyzes the content of the constitutional principle of human dignity in relation to the victim and the perpetrator of a crime. The subjective scope of this principle is characterized by the convergence of the protection of the victim and the perpetrator, whereas its objective scope is characterized by a polarization of normative consequences, as a result of the constitutional assumptions of criminal liability. The author draws attention to the prohibition of cruel, inhuman and degrading treatment interpreted in light of the protection of victims of crime.
