Roszczenia odszkodowawcze wobec podmiotów leczniczych w świetle spraw wpływających do sądów okręgowych w Polsce
Compensation claims towards healthcare entities in the light of the cases submitted to the Regional Courts in Poland

Summary/Abstract: The main aim of this article is an evaluation of damages sought by patientsclaimants with regard to the damage they sustained during their stay and treatment in healthcare entities. The author analysed what was the influx of cases in this regard to the common courts in Poland in 2005–2016, what kind of damages were related to the cases registered in the Regional Court in Łódź in 2005–2011, and how the kind of damages affects the type of compensation. All analyses were provided on a basis of data from the selected files of the Regional Court in Łódź, which were ended in a final court decision by the end of July 2015. According to the data presented in the article the following conclusions were drawn: the number of civil liability cases of the healthcare entities does not increase significantly but the value of the subject matter of the dispute varies; the most commonly reported harm is the occurrence of health disorders; the most often awarded compensation for damages is punitive damage.
