Summary/Abstract: The procedure of selection is of crucial importance regarding the functioning of the civil service system. This work analyzes the two systems of recruitment of the civil servants – a spoils system (a system of political merits) and a merit system (a system of professional abilities), with particular emphasis to the current legal decision in our state and the efforts made in terms of modernization and surpassing concerning the acceptance of a new system – the system of meritocracy. The meri-tocratic system represents a foundation for creating an expert and professional administration, which represents an essential requirement of both the citizens and the legal entities in terms of efficient fulfillment of their rights, legal interests as well as duties and obligations.
