Summary/Abstract: The presented study deals primarily with the process of transposition of the Directive on the Protection of the Environment through Criminal Law (Directive 2008/99/EC of the European Parliament and of the Council of 19 November 2008). The author suggests that there have been some major problems when introducing the above mentioned Directive into the Slovak legal system. He believes that one of the factors influencing this is the lack good lawmakers. Lawyers come across illogical legal relations and terms without being able to identify any link between them and thus lowering the level of their correct application. One of the practical problems is the proper application of the “ne bis in idem” principle.
