Summary/Abstract: A financial barrier that is hit by small and medium companies is one of the most important development barriers. Acquiring of capital from sources of traditional businesses most often encounters problems related to a short activity time and a small capital, what causes search of other sources of capital. The complexity of the problem in the light of an extensive and dynamic law environment generates an additional risk resulting from a nonuniform and leaky legislation. Above all the risk burdens companies, but it is so high that in case of realizing, it will affect investors as well. The aim of the article is to present one of such risks resulting directly form a broad disposition of the article 171 of banking law. This risk consist in a broad disposition of the legal norm generating the possibility of an interference of the financial service authority as well as of the prosecutor’s office in sourcing of foreign capital by economic entities.
