Summary/Abstract: The Czech Constitution contains in article 40 a sum of procedural specific laws which parliamentary approval is based on agreement of both chambers. One of these laws is "electoral law". For many years was disputable, what this term means: law on elections for parliament or also for regional and municipal assemblies? When the House of Deputies didn't accept the veto of the Senate against the amending law about regional and municipal elections as constitutionaly correct, disagreement between both houses of Parliament was submitted to the Constitutional Court in 2005. Constitutional Court ruled in favour of the Senate. In the Czech Republic is maybe still an open problem of difference between two types of unconstitutionality of laws: from substantive or from procedural reasons.
