Summary/Abstract: Deși textul legal al art. 28 din Legea sindicatelor nr. 54/2003 a fost abrogat prin Legea dialogului social nr. 62/2011, există și în prezent dificultăți în interpretarea dispozițiilor art. 28 alin. (2) teza I (dispoziții care au înlocuit prevederile abrogate), respectiv în interpretarea sintagmei ,,împuternicire scrisă” și, prin urmare, în legătură cu dovada calității de reprezentant a organizației sindicale. Although the provisions of article 28 of Law no. 54/2003 were repealed by Law no. 62/2011 regarding the social dialogue, there are currently difficulties of interpretation regarding the provisions of art. 28 para. (2) Ist thesis (provisions that replaced the repealed provisions), in particular with regard to the syntagma „written empowerment” and thus with the proof of being representative.
