Exhaustion of the right of distribution of computer program and back-up copy of a computer program

Summary/Abstract: Computer programs are a relatively new protected by copyright subject matter that differs from the traditional works of literature they are categorized in. First of all, their technical nature reveals a number of peculiarities regarding the content of copyrights. Such a feature is the criteria for applying to programs the principle of exhaustion of the distribution right of a work and the conditions for doing so. The case-law of the Court of Justice of the European Union has a key role for the clarification of the scope of the principle, both for computer programs and for back-up copies.
