A few de lege ferenda comments on article 384 of Electoral code

Summary/Abstract: The aim of this publication is to point lacks of harmonisation in regulations of Electoral code and Law on proceedings before administrative courts (Act of 30 August 2002), regarding proceedings before the administrative court in matters relating to questioning settlements confirming termination of councillor’s mandate. My remarks address three fundamental issues. Firstly, I will mention about suppression of dispute on councillor’s mandate termination. Secondly, I will discuss regulations ambiguities on submission and judgment of complaint and at the end I will demonstrate difficulties in determining the date of termination of councillor’s mandate in certain situations.
