CRITERIA FOR DIFFERENTIATION FORM OF COMPLICITY IN THE CRIME

Summary/Abstract: In the article certainly, that existing in science of criminal law looks, theories, conceptions in relation to the forms of participation, as well as change in the structure of criminality in Ukraine in the end ХХ of century, were taken into account at reformation of criminal statute. Taking into account philosophical and semantic interpretation of term "form" on the basis of system-structural approach such determination of concept "Form of participation" offers − method of cooperation and organization of underlying structure of joint criminal activity. Good organization is a criterion after that dividing of participation is carried out into forms in the Criminal code of Ukraine, it in a different measure is inherent to each of forms of joint criminal activity.
